Project update: June 2026

As part of our regular process of review, an updated version of the Trans-Inclusive Culture guidance is now available. This now includes information about the Supreme Court Ruling and draft EHRC guidance.

Although most of the guidance is unaffected by the EHRC Draft Code of Practice for Services, Public Functions and Associations, we have made small changes to the principles in the ethical framework regarding bathrooms and removed scenario 10, to ensure Trans-Inclusive Culture reflects recent changes in the law.

Despite claims that the EHRC code of practice would provide clarity and practical guidance to service providers it has generated further confusion and concern. Businesses, charities, service providers and community groups have highlighted the absence of clear guidance on how to continue to operate trans-inclusive services. Trans-led organisations have criticised the Code’s potential to undermine the safety and dignity of trans people and to exclude trans people from public life. Politicians from across the political spectrum and human rights organisations have criticised the code for its unworkability as well as its potential harm, not only to trans people but to other groups with protected characteristics.

We will continue to work with our team of legal and ethical experts to update the Guidance and to take account of new insights for trans-inclusive organisations as they emerge. In the meantime, this updated Guidance offers actions and strategies that can assist staff, volunteers, freelancers, managers and trustees to work together to advance trans inclusion and positively impact the experiences of trans individuals and communities.
